Independent Foreclosure Review

A blank check being heldAs part of the $9.2 billion dollar settlement between federal regulators and fourteen mortgage companies, some people began receiving checks on Tuesday, April 16, 2012.  Most of the checks are small, averaging less than a $1,000.00.  A few number of borrowers, mostly military personnel, who were improperly foreclosed on could receive as much as $125,000.00 the maximum payout.

Numerous borrowers called the Federal Reserve hotline,  on Tuesday and stated that their banks would not cash the check they received.  The checks were forwarded by Rust Consulting Inc., the paying agent, and drawn on The Huntington National Bank, the paying bank.  In a press release issued on April 17, 2013, the Federal Reserve stated that the problem has been rectified and that the funds are available to cash all checks.

3 New Initiatives for Foreclose Prevention

In an effort to continue stabilizing home values and improve conditions in communities experiencing high foreclosure activity, Acting Federal Housing Administration (FHA) Commissioner Carol J. Galante will extend FHA’s temporary waiver of the anti-flipping regulations.The Fed has released 3 new initiatives for homeowners avoid foreclosure.  To read more about these initiatives click here.

debtreliefAs part of the bill to avoid the so-called “fiscal cliff,” Congress extended the Mortgage Forgiveness Debt Relief Act for another year until January 1, 2014.  Created in 2007, the Mortgage Forgiveness Debt Relief Act protects homeowners from liability for income taxes on the portion of their primary residence’s mortgage that is forgiven in a short sale, principle reduction, or foreclosure.  Before Congress enacted this provision, the federal government taxed homeowners on the forgiven debt – also known as debt discharge income – as this was considered “taxable income.”

This news brings much needed relief to Nevadans, many of whom are seeking to modify their current home mortgages or short sell.  Nevadan homeowners can now obtain debt relief through a short sale without any tax liability for the related debt discharge income.

 

In February 2012, 49 state attorneys general, including Nevada’s AG, and the federal government announced a historic joint state-federal settlement with the country’s five largest mortgage servicers:

•Ally/GMAC

•Bank of America

•Citi

•JPMorgan Chase

•Wells Fargo

 

This is the largest consumer financial protection settlement in US history.

The agreement settles state and federal investigations finding that the country’s five largest mortgage servicers routinely signed foreclosure related documents outside the presence of a notary public and without really knowing whether the facts they contained were correct.  Both of these practices violate the law.

If you lost your home to foreclosure in Nevada between 2008 and 2011, you have probably already been notified that you may be eligible to participate in Nevada’s settlement with the National Mortgage Settlement Administrator.  THE FINAL DAY TO SUBMIT A CLAIM FORM TO BE ELIGIBLE TO RECEIVE PAYMENT IS FRIDAY, JANUARY 18, 2013.

National Mortgage Settlement — You May Be Eligible for a Distribution

Nevada’s Office of the Attorney General, Bureau of Consumer Protection, is contacting Nevada residents who are eligible to receive a portion of the settlement reached by Nevada with various mortgage servicers, including Bank of America, Wells Fargo, GMAC, Allied, and J.P. Morgan Chase.  If your mortgage was serviced by one of these institutions, and you lost your primary residence to foreclosure between January 1, 2008 and December 31, 2011, you are likely eligible to participate in the Settlement.

The Attorney General’s Office is contacting claimants by mail.  If you have not heard from their office and believe you may be eligible, you should visit ww.nationalmortgagesettlement.com to inquire.  To participate and receive the payment as part of the settlement, you must file a claim by January 18, 2013.

The California Department of Housing has released a memorandum detailing the laws that went into effect relating to lending servicers and foreclosure requirements.

The 9 page memo is a brief outline of the mandates California lawmakers imposed as a result of the mortgage crisis, robo-signing and poor performance in borrowers services.

California’s “Borrower’s Bill of Rights” is far more reaching and punitive that recent laws passed in Nevada affecting non-judicial foreclosure. Starting January 2013, offenders of any of the various requirements ranging from documentation and customer service, could pay the greater of $50,000 or trebled damages.

The Office of the Comptroller of Currency announced they are close to a $10 billion settlement with 14 banks related to the U.S. government’s efforts to hold lenders responsible for foreclosure abuses.  The announcement comes after just one month of secret talks between regulators and lenders.  Among the lenders included in the negotiations are JP Morgan Chase, Bank of America, Wells Fargo, Citigroup, and Ally financial. This tentative agreement is the latest in a series of settlements between regulators, law enforcement officials, and banks in an effort to hold lenders accountable for their role in the 2008 financial crisis and subsequent housing market slump.

The abuses cited include faulty paperwork, excessive fees and/or illegally charged fees, forcing homeowners into costly insurance, miscalculating loan payment amounts, and wrongful evictions.  The proposed settlement came after failed attempts by independent consultants to review the bank’s loan records – efforts which were both costly (approximately $1.5 billion in fees) and time consuming (each individual review taking up to 20 hours to complete).

Nevada Entities Subject to the State Business License Requirement

As part of the proposed settlement, $6 billion would be set aside for relief to current homeowners including reducing principle, refinancing high interest rate mortgages, and donating abandoned homes.  In addition, $3.75 billion would go to individuals who have already lost their homes.  The proposed settlement would also halt a consent order requiring a sweeping review of over four million bank loan files.

In addition to these efforts, federal agencies including the Security and Exchange Commission and the Justice Department continue to pursue these banks for the packaging and sale of troubled mortgage securities that imploded during the financial crisis.

Fannie Mae Foreclosures Postponed

On Monday, Fannie Mae announced that it will suspend evictions on foreclosed residential units from December 19, 2012 until January 2, 2013. That does not mean that the foreclosures will not continue, but families living in their homes will not be removed until after the 2nd day of the new year. Fannie Mae representatives stated “the holidays are a chance to be with loved ones and we want to relieve some stress at this time of year. We encourage homeowners having difficulty to reach our for help as soon as possible.”
